## 1. Agreement
These Terms and Conditions (“Terms”) govern your access to and use of the website https://streamvisualizer.com (the “Site”) and the Stream Visualizer browser-based analytics experience and related offerings (collectively, the “Services”) operated by StreamVisualizer.com (“we”, “us”, “our”).
By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
We may update these Terms from time to time. We will post the revised Terms on the Site and update the “Last updated” date below. Continued use after changes constitutes acceptance of the updated Terms, except where applicable law requires additional consent.

## 2. Intellectual property — we own the technology; you own your data
### 2.1 Our rights
Streamvisualizer.com (and/or your registered legal entity, if different) retains all right, title, and interest in and to:
– The software, analytics code, algorithms, user interface, layout, design, branding, documentation, and underlying technologies used to provide the Services (including any WordPress plugin, scripts, styles, and integrations we operate on the Site),
– Updates, improvements, and derivative works of the foregoing,
subject only to any open-source licenses that expressly apply to specific components we identify in our repository or notices (if any).
You receive no ownership of our code or technology by using the Site. You may not copy, reverse engineer, decompile, scrape, or exploit the Services except as expressly permitted by law or with our prior written consent.
### 2.2 Your data
You retain ownership of your DistroKid (or other) earnings export files and the underlying business data you provide from your device. We do not claim ownership of your raw sales rows or CSV/TSV content.
### 2.3 What a purchase covers (when offered)
If we offer paid access to downloads (for example CSV, ZIP, PDF, or PowerPoint generated from your loaded data):
– You are purchasing a limited right to use the Services to generate and download those outputs from your data in your browser, under the terms of that offer at checkout — not a sale or license of our source code, plugin IP, or core technology.
– Unless we state otherwise in writing, purchases are non-transferable and for your use (or your organization’s internal use if the product is sold that way).
## 3. Browser-based processing — no server storage of your sales file (public tool)
### 3.1 How the public tool works
The Stream Visualizer tool made available on the public pages of the Site is designed as a browser-based system: you select a file from your device; parsing, KPIs, charts, maps, Explore, and file exports run in your web browser on your device unless we clearly state otherwise on a specific page.
### 3.2 What we do not store (this public flow)
For that browser-only public flow, we do not operate the tool in a way that requires us to upload or persist your earnings CSV/TSV or parsed sales rows on our servers for analytics to function. We do not use that flow to build a database of your sales on our systems.
### 3.3 When you leave / close the session
Because processing is local to your browser session, your loaded data does not remain on our servers as part of that design. When you close the tab, navigate away, or clear site data, in-browser state (including your loaded file and generated views) typically disappears from your session, subject to your browser’s behavior and any sessionStorage or cookies described in our Privacy Policy. You are responsible for saving any exports you want to keep (for example downloading a PDF or CSV to your device).
### 3.4 Other modes
If we offer separate features (for example WordPress administrator uploads or server-side tools), those may involve storage on the server — we will describe them separately in the Privacy Policy and, if needed, in product-specific terms. These Terms’ “no server storage” statements apply to the described public browser tool unless another page explicitly says otherwise.
## 4. Accuracy of your data — your responsibility
You are solely responsible for:
– The accuracy, completeness, and legality of any files you load,
– Ensuring you have the right to use that data,
– Any decisions you make based on charts, KPIs, maps, Explore, or exports.
We are not responsible for errors, omissions, or losses arising from inaccurate, incomplete, corrupted, or mislabeled uploads, or from misinterpretation of the output.
The Services are tools for visualization and export — not accounting, tax, legal, or financial advice.
## 5. Third parties (DistroKid, stores, payment processors)
– DistroKid and other DSPs / stores named in your exports are third parties. We are not affiliated with, endorsed by, or sponsored by DistroKid unless we explicitly say so on the Site.
– Payment processing (for example Stripe, PayPal, WooCommerce) is provided by third parties subject to their terms and privacy policies. We are not responsible for their failures, outages, or data practices, except as required by law.
## 6. Acceptable use
You agree not to:
– Use the Services in violation of law or third-party rights;
– Attempt to disrupt, overload, or gain unauthorized access to our systems;
– Use automated means to scrape or bulk extract our proprietary code or non-public APIs without permission;
– Misrepresent outputs as official statements from DistroKid or any platform.
We may suspend or terminate access for violations.
## 7. Disclaimers — “as is”
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.
We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components. Browser compatibility, device performance, CDN availability, and user network conditions may affect results.
## 8. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL STREAMVISUALIZER.COM, THE ENTITY THAT OPERATES THE SITE (IF NAMED DIFFERENTLY FROM THE DOMAIN), OR OUR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SPECIFIC PRODUCT OR SERVICE GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) FIFTY U.S. DOLLARS (USD $50) IF YOU PAID NOTHING — UNLESS APPLICABLE LAW DOES NOT ALLOW SUCH A CAP.
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum permitted by law.
## 9. Indemnity
You will defend, indemnify, and hold harmless Streamvisualizer.com, the entity that operates the Site (if named differently), and our affiliates from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Services, your data, or your violation of these Terms, to the extent permitted by law.
## 10. Purchases, refunds, and taxes
If we sell digital products or access:
– Prices, taxes, and refund rules are as shown at checkout and in any product-specific terms we publish.
– You are responsible for accurate billing information.
– Chargebacks and payment disputes may result in revocation of access where permitted.
## 11. Privacy
Our Privacy Policy describes how we handle personal data (including transaction data if you purchase on the Site). It is incorporated by reference into these Terms.
## 12. Governing law and disputes
These Terms are governed by the laws of The Commonwealth of Pennsylvania, without regard to conflict-of-law rules, except where mandatory consumer protections in your country require otherwise.
If you are a consumer in the EU / UK / other region, you may have mandatory rights that cannot be waived by this section.
